Billing, Returns & Refunds Policies
1. Introduction
By using and accessing the Synthesizer.repair domain (the "Domain"), including but not limited to the website (the "Site" or "Sites"), or by making any request for services or products through the Domain, you agree to these Billing, Returns & Refunds Policies ("Policy"). If you do not agree to this Policy, please do not use or access the Domain, Site, or Sites, or submit any requests for services or products.
2. Return Policy Conditions
Our Return Policy Conditions detail the explicit criteria and procedures for managing a product return or requesting a refund (collectively, "Return"). To be eligible for a Return, you must:
- Submit a Return Request: Contact our official support email within 14 days of receiving the product to initiate a Return.
- Obtain a Return Merchandise Authorization (RMA) Number: An RMA number must be issued by our support team before you return the item.
- Maintain Original Condition: Return the item in the same condition as when it received our Quality Assurance ("QA") stamp of approval.
- Preserve All Identifiers: Ensure that the QA stamp, labels, serial numbers, and all original identifiers are intact, untampered, and unaltered.
Returns that do not meet these conditions, or that are received without a valid RMA number, will not be accepted and will be returned to you at your expense.
3. Product Condition for Returns
All items returned for a refund or exchange must be in their original, unused, and working condition, as received, with all original packaging, accessories, documentation, and any other items included in the original shipment. Products that exhibit signs of damage, tampering, misuse, or alteration will not be eligible for Return. This includes, but is not limited to:
- Missing or Altered QA Labels or Seals: Quality Assurance labels must remain intact and unaltered.
- Missing or Altered Serial Numbers: Serial numbers and other identifiers must be intact.
- Physical Damage: Any damage not reported at the time of delivery.
- Unauthorized Repairs or Modifications: Evidence of repairs or modifications not performed by Synthesizer.repair.
We reserve the right to inspect the returned item and to determine, at our sole discretion, whether the product is eligible for Return under this Policy.
4. Warranty and Lifetime Warranty Replacements
We offer warranties on certain products, including limited warranties and lifetime warranties, as specified for each product. For products covered under a warranty, you must provide reasonable proof, to our satisfaction, that the product has failed due to a defect in materials or workmanship under normal use. The determination of whether a product qualifies for warranty replacement will be made solely at the discretion of Synthesizer.repair.
Exclusions from Warranty Coverage:
- Misuse or Abuse: Damage resulting from misuse, abuse, or accidents.
- Unauthorized Alterations or Repairs: Any alterations or repairs not authorized by Synthesizer.repair.
- Improper Installation: Damage due to incorrect installation.
- Normal Wear and Tear: Routine degradation over time.
- Missing Identifiers: Products with missing or altered serial numbers, labels, or other identifying marks.
To make a warranty claim, you must contact our support team to obtain an RMA number and follow the Return procedures as outlined in this Policy. Items that do not meet these criteria will not be considered for warranty replacement or refund.
5. Return Shipping Costs
Customers are responsible for all costs associated with returning items, including shipping fees, handling charges, insurance, and any related expenses, except in cases where the Return is due to our error or a defective product covered under warranty. If the item being returned for warranty repair or replacement is found to have failed due to a quality issue or manufacturing defect, return charges will be reimbursed. We recommend using a trackable shipping method and purchasing shipping insurance, as we are not responsible for items lost or damaged in transit.
If, upon inspection, the returned item is found not to qualify under the warranty or replacement terms, you will be responsible for any return shipping costs to have the item sent back to you, if desired.
6. Billing Terms for Technical Services Engagements
Our Billing Terms for Technical Services Engagements apply specifically to technical services, including but not limited to contract work, diagnostic and bench technical services, and on-site or remote service and repair (collectively, "Technical Services"). For these services, we require a minimum billing charge equivalent to two (2) hours at the prevailing rate, regardless of the actual duration of the service. This minimum charge is necessary to cover the costs associated with providing skilled, high-quality technical work.
Exceptions:
This two (2) hour minimum billing charge does not apply to administrative tasks, including the processing of returns, customer consultations, or other non-technical assistance, which may be handled separately and may incur different charges.
Shipping & Handling
You are responsible for all charges associated with shipping, handling, and transport related to the Technical Services provided. These charges cover not only the shipment of parcels but also the careful handling and transport necessary to ensure the safe delivery and return of items. Shipping, handling, and transport charges will be combined on the final invoice along with any additional charges for Technical Services.
By engaging in any Technical Services with the Domain, you acknowledge and agree to these terms, accepting the imposition of the minimum billing charge and the responsibility for any associated shipping, handling, and transport costs as non-refundable conditions of the service engagement.
7. Limitation of Liability and Indemnification
To the maximum extent permitted by applicable law, Synthesizer.repair, its employees, officers, agents, affiliates, successors, and assigns (collectively, "Synthesizer.repair Parties") shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation, damages for loss of profits, revenue, data, or use, incurred by you or any third party, arising out of or related to these Terms, the use or inability to use our Site, products, or services, even if the Synthesizer.repair Parties have been advised of the possibility of such damages.
Total Liability Cap:
In no event shall the total aggregate liability of the Synthesizer.repair Parties to you for all claims arising out of or relating to these Terms exceed the amounts paid by you to Synthesizer.repair for the product or service in question.
Indemnification:
By using the Site or purchasing our products or services, you agree to indemnify, defend, and hold harmless the Synthesizer.repair Parties from and against any and all claims, damages, liabilities, losses, costs, and expenses (including but not limited to reasonable attorneys' fees) arising from or related to:
- Your Use or Misuse: Your use or misuse of the Site, products, or services.
- Policy Violations: Your violation of these Terms or any other applicable terms or agreements.
- Legal Violations: Your violation of any applicable laws, regulations, or third-party rights.
8. Changes to the Terms
Synthesizer.repair reserves the right, at its sole discretion, to update, modify, or replace these Terms at any time without prior notice. Any changes to the Terms will be effective immediately upon posting on the Site. Your continued use of the Site, products, or services following the posting of any changes constitutes your acceptance of those changes. 9. Governing Law and Jurisdiction
These Terms and any disputes arising out of or related to them or your use of the Site, products, or services shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
You agree that any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the federal or state courts located in the State of Oregon. You hereby irrevocably consent to the personal jurisdiction of these courts and waive any objections based on venue or inconvenient forum.
10. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason by a court of competent jurisdiction, such provision shall be eliminated or limited to the minimum extent necessary so that the remaining provisions of these Terms shall continue in full force and effect.
11. Entire Agreement
These Terms constitute the entire agreement between you and Synthesizer.repair regarding the subject matter herein and supersede all prior or contemporaneous agreements, understandings, representations, and warranties, whether written or oral, regarding such subject matter.
